An Anambra State-based businessman, Tochukwu Nwosu, has filed a lawsuit against a police officer, CSP Ifeanyi Iburu, for unlawful arrest and detention.

Nwosu said he was unlawfully arrested and detained at the cell of the Police Rapid Response Squad, Awkuzu, between the hours of 10 am and 10 pm on September 4 by CSP Iburu, thereby constituting a breach of his right to personal liberty and runs contrary to the spirit and letters of section 35 of the constitution.

In a case filed at the High Court of Anambra State, Awka, Nwosu is seeking compensation of N20 million for the violation of his fundamental human rights to personal liberty.

According to a court document sighted by our correspondent on Monday, with suit number A/AMISC 392/2024, Nwosu was arrested on September 4, 2024, at Kamali Phase III, behind Dubai Estate, Awka, at 10 am without any justifiable reason.

Following his arrest, he was subsequently detained inside the cell of the Police Rapid Response Squad, Awkuzu Anambra State, from 10 am to 10 pm, further infringing on his human rights.

The applicant’s counsel, Joseph O. Eze and Associates, submitted that the arrest and detention were a clear violation and breach of Nwosu’s fundamental rights as enshrined in the 1999 Nigerian Constitution, as amended.

According to the sighted document, the respondent, CSP Ifeanyi Iburu, is accused of abusing his power and violating the applicant’s rights without any lawful justification.

Nwosu’s counsel also prayed that the court declare the arrest and detention unlawful and award N20 million in compensation for the damages suffered.

“This case highlights concerns about police brutality and the need for law enforcement agencies to respect citizens’ fundamental rights.

“The outcome of this case will have significant implications for the protection of citizens’ rights and the accountability of law enforcement agencies in Anambra State,” the document stated.
